Private Liability Insurance: A Small Moment, a Lifelong Impact for Expats in Germany

It happens faster than you think: A brief moment of distraction, and damage is done. Whether it is dropping a friend's smartphone or – much worse – causing a traffic accident as a pedestrian or cyclist. In Germany, the law is strict: If you cause damage, you are liable with your entire current and future assets. Private Liability Insurance (Privathaftpflichtversicherung) is is therefore very important, but the absolute most important protection for every expat in Germany.

Sarah's Story: The most expensive "Oops" of her life

Let me tell you Sarah's story. Sarah is a software developer who recently moved to Berlin. One sunny morning, she was cycling to her new office. She was a bit late and momentarily lost focus. She overlooked a pedestrian who was about to cross the street. They collided.

The pedestrian fell badly and suffered a complicated hip fracture. What followed was a nightmare: hospital stays, long-term rehabilitation, claims for pain and suffering, and the cost of permanent walking aids. The total claims amounted to over €80,000.

For Sarah, who had just started building her savings, this could have meant financial ruin before her career in Germany had even properly begun. She would have had to give up a part of her salary for decades to pay off this debt. Luckily, Sarah had listened to the advice to get private liability insurance immediately after arriving. The insurance not only handled all communication with the lawyers but also paid the justified claims to the last cent. Sarah learned the hard way: a small mistake should not ruin your entire future.

Why Private Liability is essential for Expats in Germany

According to § 823 of the German Civil Code (BGB), you are must pay for damages if you on purpose or by accident injure the life, body, health, freedom, property, or another right of another person.

A good private liability policy fulfills three important functions:

  • Verification: It checks whether you can actually be held responsible for the damage.
  • Defense: It defends you against unjustified claims (acting as a "passive" legal protection).
  • Satisfaction: It pays for justified claims for personal injury, property damage, or financial loss.

What to look for in a policy

Not all liability insurances are the same. While the premiums are very affordable (often starting at €4–€6 per month), the differences in coverage are massive. In my neutral online consultation, I pay special attention to:

  • Sum Insured: It should be at least €50 million today, especially for personal injuries.
  • Bad Debt Coverage: What happens if someone else causes damage to you, but they don't have insurance and have no money? Your own insurance will pay for your damage.
  • Damages during favors (Gefälligkeitsschäden): You help a friend move and drop their TV. Many standard policies don't pay here – good ones do.
  • Loss of Keys: Whether it's your apartment key or your office master key – replacing a locking system can be extremely expensive.
  • Borrowed Items: Did you borrow a professional camera or tool from a neighbor and it broke? This should be covered.

Specifics for Families, Pet Owners, and Homeowners

I advise you individually based on your life situation. Families need a plan that includes "delict-incapable children" (under 7 years old) to avoid trouble with neighbors if the kids accidentally scratch a car.

Are you a proud owner of a dog or a horse? Then private liability is not enough – you need a specific Pet Owner Liability Insurance. And if you rent out a property, we should talk about Homeowner's Liability.

Requirements for Expats

Frequently Asked Questions

Is it really that cheap?
Yes, it is arguably the best value insurance in Germany. High-end coverage costs about €50 to €80 per year. Compared to the potential risk of millions in liability, it is a must-have.
Does it cover my bike?
It covers damages *you cause* to others while cycling. If your bike is stolen, you need "Household Insurance" (Hausratversicherung) instead.
Are my children automatically included?
In a family plan, yes. Crucially, good policies also pay when children under 7 (or under 10 in traffic) cause damage, even though they are technically not legally liable yet.
Does it cover damage to my rented apartment?
Yes, "Mietsachschäden" (damages to rented property) is a vital part of the policy. It covers damage to the building, floors, or built-in kitchens. It does not cover damage to your own furniture (that's Household Insurance).
What if I move back to my home country?
You can cancel the insurance immediately upon leaving Germany. Modern plans are very flexible.
Are pets covered?
Small pets like cats, birds, or hamsters are included in the private liability. For dogs and horses, you need a separate liability insurance by law in most German states.
